The following data protection declaration applies to the use of our online offer at www.trex-gmbh.de, www.trex.gmbh and www.trex.pl (hereinafter "website(s)").


TREX GmbH attaches great importance to data protection. The collection and processing of your personal data takes place in compliance with the applicable data protection regulations, in particular the European General Data Protection Regulation (GDPR) and the provisions of the Federal Data Protection Act (BDSG).

2. Security notice


TREX GmbH considers it a priority to maintain the confidentiality of the personal data you provide and to protect it from unauthorized access. We therefore apply the utmost care and the latest security standards to ensure maximum protection of your personal data.


When communicating by email over the Internet, however, we cannot guarantee complete data security, so we recommend that you send confidential information by post.


2.1 Data security

We make every effort to ensure the security of your data within the framework of applicable data protection laws and technical possibilities.


Your personal data is transmitted in encrypted form. We use the SSL (Secure Socket Layer) coding system, but would like to point out again that data transmission over the Internet (e.g. when communicating by email) can have security gaps. Complete protection of data against access by third parties is not possible.


To protect your data, we maintain technical and organizational security measures in accordance with Art. 32 GDPR, which we continually adapt to the state of the art.


We also do not guarantee that our offer will be available at certain times; disruptions, interruptions or failures cannot be ruled out. The servers we use are regularly and carefully backed up.



3. General purpose of data processing


TREX GmbH uses personal data for the purpose of providing the online service, operating the website, its functions and contents, answering contact requests and communicating with users, security measures, marketing and reach measurement.



4. Terminology


The legislator requires that personal data be processed lawfully, in good faith and in a manner that is understandable for the person concerned (“lawfulness, processing in good faith, transparency”). To ensure this, TREX GmbH informs you about the individual legal definitions that are also used in this data protection declaration:


4. 1 Personal data
“Personal data” is all information that relates to an identified or identifiable natural person (hereinafter “data subject”); a natural person is considered identifiable if he or she can be identified directly or indirectly, in particular by assignment to an identifier such as a name, an identification number, location data, an online identifier or to one or more special characteristics that express the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.


4. 2 File system
“File system” is any structured collection of personal data that is accessible according to specific criteria, regardless of whether this collection is centralized, decentralized or organized according to functional or geographical aspects.


4. 3 Processing
“Processing” is any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or any other form of provision, comparison or linking, restriction, erasure or destruction. The term covers practically every handling of data.


4. 4 Pseudonymisation
“Pseudonymisation” is the processing of personal data in such a way that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that this additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data cannot be attributed to an identified or identifiable natural person.


4. 5 Profiling
“Profiling” is any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.


4. 6 Controller
“Controller” is a natural or legal person, public authority, agency or other body which alone or jointly with others decides on the purposes and means of processing personal data.


4.7 Processor
“Processor” means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.


4.8 Recipient
“Recipient” means a natural or legal person, public authority, agency or other body to which personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular investigation in accordance with Union or Member State law shall not be regarded as recipients; the processing of those data by those public authorities shall be in compliance with the applicable data protection rules in accordance with the purposes of the processing.


4.9 Third party
“Third party” means a natural or legal person, public authority, agency or body other than the data subject, the controller, the processor and the persons authorised to process the personal data under the direct responsibility of the controller or processor.


4.10 Consent
“Consent” of the data subject is any freely given, specific, informed and unambiguous indication of the data subject’s wishes in the form of a statement or other unambiguous affirmative action by which he or she signifies agreement to the processing of personal data concerning him or her.



5. What data we use and why


5.1 Hosting and log files

The hosting services used by TREX GmbH serve to provide the following services: infrastructure and platform services, computing capacity, storage space and database services, security services and technical maintenance services that we use for the purpose of operating the website.


We or our hosting provider process inventory data, contact data, content data, contract data, usage data, meta and communication data of customers, interested parties and visitors to this website on the basis of our legitimate interests in the efficient and secure provision of our website in accordance with Art. 6 Para. 1 Clause 1 f) GDPR in conjunction with Art. 28 GDPR.


5.2 Access data

We collect information about you when you use this website. We automatically collect information about your usage behavior and your interaction with us and register data about your computer or mobile device. We collect, store and use data about every access to our website (so-called server log files). The access data includes:


  • Name and URL of the retrieved file
  • Date and time of retrieval
  • Amount of data transferred
  • Message about successful retrieval (HTTP response code)
  • Browser type and browser version
  • Operating system
  • Referrer URL (i.e. the previously visited page)
  • Websites accessed by the user's system via our website
  • User's Internet service provider
  • IP address and the requesting provider

We use this log data without assigning it to you personally or creating any other profile for statistical evaluations for the purpose of operating, securing and optimizing our website, but also for anonymously recording the number of visitors to our website (traffic) and the extent and type of use of our website and services, as well as for billing purposes in order to measure the number of clicks received from cooperation partners. Based on this information, we can provide personalized and location-based content and analyze data traffic, search for and correct errors and improve our services.


This is also our legitimate interest in accordance with Art. 6 Para. 1 Clause 1 f) GDPR.


We reserve the right to subsequently check the log data if there is a justified suspicion of illegal use based on concrete evidence. We store IP addresses in the log files for a limited period of time if this is necessary for security purposes or for the provision or billing of a service, e.g. if you use one of our offers. After the order process has been canceled or after payment has been received, we delete the IP address if it is no longer required for security purposes. We also store IP addresses if we have a specific suspicion of a criminal offense in connection with the use of our website. We also store the date of your last visit as part of your account (e.g. when registering, logging in, clicking on links, etc.).


5.3 Data to fulfill our contractual obligations

We process personal data that we need to fulfill our contractual obligations, such as name, address, email address, ordered products, invoice and payment data. The collection of this data is necessary for the conclusion of the contract.


The data will be deleted after the warranty period and statutory retention periods have expired. Data linked to a user account (see below) will always be retained for the duration of the account.


The legal basis for processing this data is Art. 6 Para. 1 Clause 1 b) GDPR, because this data is required so that we can fulfill our contractual obligations to you.



6. Use and disclosure of personal data


If you have provided TREX GmbH with personal data, we will only use it to answer your inquiries, to process contracts concluded with you and for technical administration.


Your personal data will only be passed on or otherwise transmitted to third parties if this is necessary for the purpose of contract processing - in particular passing on order data to suppliers - if this is necessary for billing purposes or if you have previously consented. You have the right to revoke your consent at any time with effect for the future.


The stored personal data will be deleted if you revoke your consent to storage, if knowledge of it is no longer required to fulfil the purpose for which it was stored, or if its storage is not permitted for other legal reasons.



7. Cookies


TREX GmbH uses so-called session cookies to optimize our website. A session cookie is a small text file that is sent by the respective servers when you visit a website and is temporarily stored on your hard disk. This file as such contains a so-called session ID, with which various requests from your browser can be assigned to the common session. This allows your computer to be recognized when you return to our website. These cookies are deleted after you close your browser. They are used, for example, to enable you to use the shopping cart function across multiple pages.


We also use persistent cookies to a small extent (also small text files that are stored on your device), which remain on your device and enable us to recognize your browser the next time you visit. These cookies are stored on your hard disk and delete themselves after the specified time. Their lifespan is 1 month to 10 years. This allows us to present our offer to you in a more user-friendly, effective and secure way and, for example, to show you information on the site that is specifically tailored to your interests.


Our legitimate interest in using cookies in accordance with Art. 6 Paragraph 1 Clause 1 f) GDPR is to make our website more user-friendly, effective and secure.

When the cookie is activated, it is assigned an identification number and your personal data is not assigned to this identification number. Your name, IP address or similar data that would enable the cookie to be assigned to you are not stored in the cookie. Based on cookie technology, we only receive pseudonymized information, for example about which pages of our shop were visited, which products were viewed, etc.


You can set your browser so that you are informed in advance about the setting of cookies and can decide in individual cases whether you want to exclude the acceptance of cookies for certain cases or in general, or whether cookies are to be blocked completely. This can limit the functionality of the website.

9. Google Analytics


This website uses functions of the web analysis service Google Analytics. The provider is Google Inc., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA.


Google Analytics uses so-called "cookies", text files that are stored on your computer and that enable an analysis of your use of the website. The information generated by the cookie about the use of this website by visitors is usually transferred to a Google server in the USA and stored there.


This is also our legitimate interest in accordance with Art. 6 Paragraph 1 Clause 1 f) GDPR.


Google has submitted to and certified itself under the Privacy Shield Agreement concluded between the European Union and the USA. This means that Google undertakes to comply with the standards and regulations of European data protection law. You can find more information in Google's privacy policy. There you can also change your personal data protection settings in the data protection center.


We have activated IP anonymization on this website. However, this means that your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. Google will use this information on our behalf to evaluate your use of the website, to compile reports on website activity and to provide us with other services relating to website activity and internet usage.


The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. You can prevent cookies from being saved by setting your browser software accordingly; however, we would like to point out that in this case you may not be able to use all of the functions of this website to their full extent.

10. Product recommendations


Independently of the newsletter, we regularly send you product recommendations by email. In this way, we send you information about products from our range that you might be interested in based on your last purchases of goods or services from us. In doing so, we strictly adhere to the legal requirements. You can object to this at any time without incurring any costs other than the transmission costs according to the basic rates. A message in text form to the contact details specified under point 1 (e.g. email, fax, letter) is sufficient for this. Of course, you will also find an unsubscribe link in every email.


The legal basis for this is the legal permission according to Art. 6 Para. 1 Clause 1 f) GDPR in conjunction with Section 7 Para. 3 UWG.



11. Online presence in social media


TREX GmbH maintains online presences within social networks and platforms in order to be able to communicate with customers, interested parties and users active there and to inform them about our services. When accessing the respective networks and platforms, the terms and conditions and data processing guidelines of their respective operators apply.


Unless otherwise stated in our data protection declaration, we process the data of users if they communicate with us within the social networks and platforms, e.g. write posts on our online presences or send us messages.



12. Use of social media plugins ("Like" buttons etc.)


12.1 Facebook plugins (Like button)

Our website contains plugins from the social network Facebook, 1601 South California Avenue, Palo Alto, CA 94304, USA (responsible in Europe: Facebook Ireland Ltd., 4 Grand Canal Square

13. Storage period


Unless specifically stated, TREX GmbH only stores personal data for as long as it is necessary to fulfill the purposes pursued.


In some cases, the legislator provides for the retention of personal data, for example in tax or commercial law. In these cases, we only continue to store the data for these legal purposes, but do not process it in any other way and delete it after the statutory retention period has expired.



14. Transfer of data to third parties, no data transfer to non-EU countries


TREX GmbH generally only uses your personal data within its own company.

If and to the extent that we engage third parties to fulfill contracts (such as logistics service providers), they will only receive personal data to the extent that the transfer is necessary for the corresponding service.


In the event that we outsource certain parts of the data processing (“contract processing”), we contractually oblige contract processors to only use personal data in accordance with the requirements of data protection laws and to ensure the protection of the rights of the data subject.


Data transfer to locations or persons outside the EU outside of the case mentioned in section 9 of this declaration does not take place and is not planned.



15. Your rights as a data subject


Under the applicable laws, you have various rights with regard to your personal data. If you would like to assert these rights, please send your request by email or post to the address specified in section 1, clearly identifying yourself.


Please note that with such requests we must ensure that it is actually the person concerned.


Below you will find an overview of your rights.


15.1 Right to confirmation and information (according to Art. 15 GDPR)

You have the right to clear information about the processing of your personal data.


In detail:


You have the right at any time to receive confirmation from us as to whether personal data concerning you is being processed. If this is the case, you have the right to request information from us free of charge about the personal data stored about you, along with a copy of this data. You also have the right to the following information:


  1. the purposes of processing;
  2. the categories of personal data that are processed;
  3. the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations;
  4. if possible, the planned duration for which the personal data will be stored, or, if this is not possible, the criteria for determining that duration;
  5. the existence of a right to rectification or erasure of the personal data concerning you or to restriction of processing by the controller or a right to object to such processing;
  6. the existence of a right to lodge a complaint with a supervisory authority;
  7. if the personal data are not collected from you, all available information on the origin of the data;
  8. the existence of automated decision-making, including profiling, in accordance with Art. 22 (1) and (4) GDPR and - at least in these cases - meaningful information on the logic involved and the scope and intended effects of such processing for you.

If personal data is transferred to a third country or to an international organisation, you have the right to be informed of the appropriate guarantees in accordance with Art. 46 GDPR in connection with the transfer.


15.2 Right to rectification (according to Art. 16 GDPR)

You have the right to request that we rectify and, if necessary, complete personal data concerning you.


In detail:


You have the right to request that we immediately rectify any inaccurate personal data concerning you. Taking into account the purposes of the processing, you have the right to request that incomplete personal data be completed - also by means of a supplementary declaration.


15.3 Right to erasure ("right to be forgotten") (according to Art. 17 GDPR)

In a number of cases, we are obliged to erase personal data concerning you.


In detail:


According to Art. 17 Para. 1 GDPR, you have the right to request that we erase personal data concerning you immediately, and we are obliged to erase personal data immediately if one of the following reasons applies:


  1. The personal data are no longer necessary for the purposes for which they were collected or otherwise processed.
  2. You withdraw your consent on which the processing was based in accordance with Art. 6 Para. 1 Sentence 1 a) GDPR or Art. 9 Para. 2 a) GDPR, and there is no other legal basis for the processing.
  3. You object to the processing in accordance with Art. 21 Para. 1 GDPR and there are no overriding legitimate reasons for the processing, or you object to the processing in accordance with Art. 21 Para. 2 GDPR.
  4. The personal data were processed unlawfully.
  5. The deletion of the personal data is necessary to fulfill a legal obligation under Union or Member State law to which we are subject.
  6. The personal data were collected in relation to information society services offered in accordance with Art. 8 (1) GDPR.

If we have made the personal data public and are obliged to delete them in accordance with Art. 17 (1) GDPR, we shall take appropriate measures, including technical ones, taking into account the available technology and the implementation costs, to inform data controllers who process the personal data that you have requested them to delete all links to these personal data or copies or replications of these personal data.


15.4 Right to restriction of processing (in accordance with Art. 18 GDPR)

In a number of cases, you are entitled to request that we restrict the processing of your personal data.


In detail:


You have the right to request that we restrict processing if one of the following conditions is met:


  1. you contest the accuracy of the personal data for a period that enables us to verify the accuracy of the personal data,
  2. the processing is unlawful and you have refused to delete the personal data and instead requested that the use of the personal data be restricted;
  3. we no longer need the personal data for the purposes of processing, but you need the data to assert, exercise or defend legal claims, or
  4. you have objected to processing in accordance with Art. 21 Para. 1 GDPR, as long as it has not yet been determined whether our company's legitimate reasons outweigh yours.

15.5 Right to data portability (according to Art. 20 GDPR)

You have the right to receive, transmit or have us transmit personal data concerning you in a machine-readable format.


In detail:


You have the right to receive the personal data concerning you that you have made available to us in a structured, common and machine-readable format and you have the right to transmit this data to another responsible party without hindrance from us, provided that


  1. the processing is based on consent in accordance with Art. 6 Para. 1 Sentence 1 a) GDPR or Art. 9 Para. 2 a) GDPR or on a contract in accordance with Art. 6 Para. 1 Sentence 1 b) GDPR and
  2. the processing is carried out using automated procedures.


When exercising your right to data portability in accordance with paragraph 1, you have the right to have the personal data transmitted directly by us to another responsible party, insofar as this is technically feasible.


15.6 Right of objection (according to Art. 21 GDPR)

You have the right to object to the lawful processing of your personal data by us if this is based on your particular situation and our interests in the processing do not outweigh them.


In detail:


You have the right to object at any time to the processing of personal data concerning you based on Art. 6 Para. 1 Clause 1 e) or f) GDPR for reasons arising from your particular situation; this also applies to profiling based on these provisions. We will no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing which outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.


If we process personal data in order to conduct direct advertising, you have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising; this also applies to profiling insofar as it is related to such direct advertising.


You have the right to object to the processing of personal data concerning you for scientific or historical research purposes or for statistical purposes pursuant to Art. 89 (1) GDPR, unless the processing is necessary to perform a task carried out in the public interest, for reasons related to your particular situation.


15.7 Automated decisions including profiling (according to Art. 22 GDPR)

You have the right not to be subjected to a decision based exclusively on automated processing - including profiling - that has legal consequences for you or significantly affects you in a similar way.


Automated decision-making on the basis of the personal data collected does not take place.


15.8 Right to withdraw consent under data protection law (according to Art. 7 (3) GDPR)

You have the right to withdraw consent to the processing of personal data at any time.


15.9 Right to complain to a supervisory authority (according to Art. 77 GDPR)

The data subject has the right to complain to a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or work or of our company headquarters.



16. TREX GmbH - Objection to advertising emails


The use of contact data published as part of the imprint obligation to send unsolicited advertising and information materials is hereby objected to. TREX GmbH, as the operator of the websites, expressly reserves the right to take legal action in the event of unsolicited advertising information being sent, for example through spam emails.

This privacy statement is currently valid and is dated June 2018.
